Bristol Police Release Sex Offender Notice

The offender is not wanted by police at this time

 

NOTE: The offender is not wanted by the police at this time and has served the sentence imposed on him by the court. This notification is not to increase fear in the community. It is the belief of law enforcement that an informed public is a safe public.

The Bristol Police Department released the following information persuant to RI General Laws in relation to the Sexual Offender Registration and Community Notification Act.

James McKay, 27, of 18 Ryan Avenue, second floor, is a risk level three sex offender. He was convicted of two counts of First Degree Child Molestation and failure to register. The two victims were 9 and 10-year-old females who were both known to the offender.

McKay is a caucasian male with brown hair and brown eyes. He is six-feet tall and weighs 165 lbs. His probation expires on May 14, 2014. He is not wanted by police at this time.

If he is living on Ryan St., he is living way too close to a school and the playground at the town common. .

Not only is this offender living on Ryan Street. I have also contacted the school dept to find out why Augustine Sousa a level 2 offender is living at 144 Bradford Street a block away from Colt Andrews, a daycare on the corner of High and Bradford, and also a girls group home on the corner of Bradford and High......I have not recieved any response from the school dept and I also contacted Sara Bagwell to report on this.

Justfiable concerns. His record shows that he has been arrested for the sex offense, re-arrested for failing to register his address, violating restraining orders, obstruction.
The residents in that area have a legitimate concern however, as stated in the article, HE IS NOT WANTED. He paid his time, this service is provided so that people know to keep an eye on their kids.

Moi you obviously don't have any children. But you are absolutely right I will live in fear for I am a parent who is appalled that men like that are even allowed to return to society to prey on our children.

People are almost forced to over react when reading a comment like: "(Enjoy living in fear....sheep.)" A comment such as that breeds nothing but contempt for an individual such as this man, while many others have made a great many mistakes in life, praying on children and attempting to make families uncomfortable of their surroundings is nothing in comparison to this, it causes nothing but trouble. While I would like to think that these people will never again hurt a child, Im not willing to take any chances with my kids or anyone elses to find out if their rehabilitated.

I understand everyone's concerns on this matter. As a parent I am also very concerned. What I really don't understand is why no one is concerned with the the soup kitchen down town. Have you looked at the people coming in and our of our town daily. Have we done a back round check on any of these people? I understand charity and the good it does. But the soup kitchen is killing the downtown business flow. I mean honestly would you go into the real estate office at the corner of Hope and Church Streets with all of them sitting on the front stairs? These people are loitering all over the place. I live in Bristol and I love our town. People always say Bristol's down town is better than Warren's, But Warren's store fronts are all full and Bristol looks like a ghost town. I am not saying this is all the soup kitchen's fault. But lets be honest it does not help.

The people who frequent the soup kitchen are not all bad, I've seen single mothers with children using the facility, however I see a great deal of persons who appear to be homeless, they loiter in front of the soup kitchen, then head to the liquor stores to get their alcohol and God knows what. Unfortunately, the library is their place to frequent in inclement weather. I've witnessed persons of unsavory means in the library and I feel uncomfortable visiting the library on rainy days with my grandchild because of these characters. Bristol has a beautiful library which has turned into a day shelter for these people, it really is unfortunate.

Looking at his record I can't see the actual sex offender charges just a lot of failure to register and the obstruction charges. With all these registration charges it makes me think he came here from out of state to avoid being known hence that initial charge for obstruction - he would give the wrong name to avoid being known.

2005 - The original RI case was obstruction - he gave another name to Newport Police.

2006 - There was a 'sex offender registration' case brought by Middletown Police but that sounds like they were registering him not the sexual assault charge. This was adjudicated in Feb 2007.

2007 - Feb 2007 'sex offender registration' 5 days to serve 3 years probation During this he violated his bail. Then was sentenced on that with no apparent extra time or probation in May 2009. Same case April 2009 presented as a violator. May 2010 it says 'completed so no extra probation for that.

2007 - Violation of a protective order. RISP 1 year suspended 1 year probation.
This was from June 2007. The court should have had him serve time on this because it happened after the charge. This was the 'bail violation' on the other charge that year. Newport County has some soft touch Judges thats for sure.

2008 September sex offender address change. No violation hearing no time. Middletown PD It took them till April 2009 to resolve this.

2009 April sex offender address change brought by Middletown PD - This happened during the other probation/3 year suspended sentence. 64 days to serve with the balance of 5 years suspended which makes the 2014 end of probation mentioned in the article here.

June 2011 possession of marijuana Middletown PD a fine.

Sexual offenders are sick and they are not cured by jail. There is something inherently wrong with them. I'm not saying that to downplay the behavior - just the opposite hence the registration process. People with children have every right to be careful with these people in the area and I believe that proximity to schools is a legal issue maybe something concerned parents should call the police about and voice concerns.

I think the people that use the soup kitchen are a problem downtown- and the problem is getting worse. I do agree that not all of them are bad people.
Let's be honest though- most of them are questionable at best. They range in ages from early 20's on up. They all congregate early in the morning, drink their free coffee and smoke cigarettes outside. They block sidewalks and panhandle. Most of them look perfectly capable of work. Some look like they belong in a more confined environment.
There's a daycare/school across the street and an elementary school in the near vicinity. Could anyone with young children in either school honestly say that they're not worried about hteir childrens' welfare?
On top of that we have a few known sex offenders in the area as well. I have children that attend public schools and I worry about their safety.
When criminals have more rights than law abiding citizens something is seriously wrong.

Well you can thank RIPTA for that. Communities that have bus service are vulnerable to unwelcome migration from other areas.

Given what you describe with the 'soup kitchen' (I didn't know there was one other than at St Michaels - is that the one you refer to?) maybe an officer should be parked in the area during that time they are open and a little before and after.

HOW ABOUT ALL OF YOU CHILL.
1. GIVE THE MAN A CHANCE; He served his sentence and obviously got the help he needs.
2. LET HIM MOVE ON WITH HIS LIFE; Would you rather he continued to do what he's done here in Bristol, or would you rather have him be a productive member of society? Based on your comments your almost wishing he does it again.
3. YOU CAN JUDGE HIM ALL YOU WANT IF HE SCREWS UP AGAIN; Sure, I agree, based on his record, if this guy screws up one more time he should be done. But, for the time being give the guy a chance to start a new chapter.

Downtown- you're right. Most of the people that go to the soup kitchen(and thousands across the state) have free bus passes that take them wherever they want. So every time you hear of budget cuts for Ripta think of that.
And to answer your question I was referring to the soup kitchen at St. Michaels, but we have a second one located on Wood St near Franklin in the Kaiser complex.
And to anyone that doesn't think that the loitering and panhandling is a problem take a ride down to the Broadway area of Newport- ask any business owner from lower Broadway if it's a problem- and it's coming soon to a town near you!

I have relatives in Winthrop, MA. If you know anything about the surrounding communities East Boston & Revere you would have to wonder why Winthrop hasn't been 'over run'. I attribute it to the fact that neither the T nor any buses that allow free passes go to Winthrop. It's protected.

I use to see large groups walk up from Hope Street after getting off the bus to whatever factory in the old US Rubber/Kaiser area hired them. They would walk up in the middle of the street instead of the sidewalks and go through the trash barrels on dump days tossing stuff on the ground etc.

Yes, thanks for the buses (heavy sarcasm).

For the sex offender notice to have been pulbished it had to be part of what is required by the law. They kow where he lives so if he was violating the location he was allowed he would not be allowed their and this would not have been published.
As far as the food kitchen, lets not judge a book by the cover. Most of them do need a free meal and are harmelesl, some do take advantage of the handouts but its society today. We are fortunate to be able to feed those less fortunate, lets not be selfish and think we are better than others, be thankful that you have food and a roof over your head and stop worring about the little things in life.

I have a roof over my head because I work hard for it- I don't ask for handouts.
I don't feel I'm selfish at all- I do think that people need to stop being so dependent on the taxpayers, get some pride , lift their chin up and take responsibilities for their actions.
I'm tired of being taxed to death while the gov't rolls out more programs.
It's not just Bristol- it's across the globe.
Look at Greece, Portugal, etc- people get pensions for doing hardly any work.
In the US 48% of the people pay taxes- how long do you think we'll survive with these numbers?
Enough of this political correctness.
